Litigation

Contract Disputes

People enter into contracts everyday, for the supply of goods and services for example. Unfortunately, not everyone keeps their promises that they make in a contract. In many cases, people suffer damage as result. When this occurs, you should seek legal advice. We can advise you:

  • about the terms of the contract;
  • whether such terms are enforceable and how they can be enforced;
  • any other remedies that might be available to you under the Trade Practices Act, Fair Trading Act and Contracts Review Act;
  • your entitlements under the contract;
  • alternatives to litigation, such as Alternative Dispute Resolution.

Commercial Litigation

In the commercial world, it is often the case that not everything runs smoothly. Disputes can arise in commerce in many areas, such as the supply of defective goods; misleading or deceptive statements about matters in the contract and unfair clauses in a contract are examples.  Before you commence litigation, it is important that you get legal advice. We can advise you:
  • whether your case has good prospects of success;
  • the estimated cost of litigation;
  • about Alternative Dispute Resolution.
We can negotiate on your behalf and achieve the best possible outcome for you.

Enforcement of Rights

You have a valid contract, and you want to enforce it, what next?  Although you might have a contract, it is no guarantee that you will be able to enforce your rights under the contract and be successful in recovering your loss. We can advise you:
  • How to enforce a contract, what are your options;
  • Any defences that can be raised by the other party;
  • Enforcing guarantee clauses and their availability;
  • Any difficulties that you might have enforcing a contract.
