Conveyancing
From the outset we will provide you with an estimate of our costs and disbursements. As the matter progresses we will update that estimate based on negotiations on your behalf regarding the terms of the Contract, special requirements of your mortgagees and other action that might be required, for example, arising out of your changing needs or breaches of the Contract by the other party to the transaction.
In addition to the usual real property/strata title transaction, our firm has considerable experience in:
- Old System title;
- Qualified and Limited title;
- Company title;
- Leasehold title.
Buying Real Estate
An estimate of our costs and disbursements, searches and stamp duty can be provided at the first appointment. We will advise you from the start what searches should be undertaken prior to an auction or exchange of Contracts. As your matter progresses the estimate will be reviewed and discussed with you in the light of any changing circumstances.
Selling Real Estate
An estimate will be provided to you at the first appointment. A Contract for Sale needs to be prepared and provided to the agent before the property is marketed. Special Conditions can be drafted to meet your particular circumstances whether it is a delayed settlement or if you are selling in the capacity of an Executor of an estate.
Mortgages and Refinancing
The costs and procedures for mortgages and refinancing can usually be provided at the first appointment or when the mortgagee’s documents are prepared and the mortgagee sets out its requirements. There is a significant difference between the requirements of mortgagees.
Staged Development Sales
We have acted for both Vendors and Purchasers in relation to staged development sales. It is important that the documentation fairly discloses the circumstances and provides appropriate mechanism for dealing with matters that might change.
Purchases off the Plan
We have acted for both Vendors and Purchasers in relation to sales and purchases off the plan. Proper documentation is important to know where each of the parties stand and that proper timing is allowed for settlements without penalty.
